Attorney Amanda Farahany Joins Local News to Discuss the Confederate Flag Controversy & Workplace Discrimination Issues

While the Confederate Flag is being removed from public displays and even retail settings throughout the U.S., some are starting to see the flag being put up in other places – like in their work environments.

Atlanta Employment Discrimination Lawyer Amanda Farahany was featured on local news last night to discuss how the Confederate Flag controversy may be triggering workplace discrimination issues.

Yesterday, one of our managing partners, Attorney Amanda Farahany, met with an anchor at 11Alive in Atlanta to talk about the Confederate Flag controversy and how it may be triggering workplace discrimination issues.

Pointing out some specific concerns, Farahany explained that:

[At Barrett & Farahany, LLP], we’re hearing from employees that there are bosses and coworkers that not only are talking about the Confederate Flag but actually are putting the Confederate Flag up at work. And they’re concerned it’s creating a hostile work environment and trying to find out what they can do.

Elaborating on the when displays of the Confederate Flag may infringe on people’s rights, Farahany went on to note that, “employees can use the Confederate Flag once they are outside of the workplace, but inside the workplace, an employer has an obligation to ensure that a hostile work environment is not created… an employer should make sure that its employees are not displaying something that has such a blatant type of racist history behind it.”

So, while people may have the right to display the Confederate Flag on their property or to wear clothing with images of the Confederate Flag during their free time, when they are at work, different laws apply. Additionally, these displays of the Confederate Flag at work can become illegal if or when they contribute to a hostile work environment for anyone else in that work environment.

Elucidating this point, Farahany stated that, “once you step foot into the workplace, those rights are not the same… race discrimination is one of the laws that actually deals with the Confederate Flag itself.”
